Broad Street Dental practice aims to meet the requirements of the Data Protection (Jersey) Law 2018, the General Data Protection Regulation (GDPR), guidelines set out by the Jersey Office of Information commissioner (JOIC) website as well as our professional guidelines and requirements set out by the General Dental Council (GDC).

The Data Controller is Broad Street Dental, the Data protection officer is Dr Ivo Raitchev.

You will be asked to provide personal information when joining the practice, the purpose of processing this data is to provide you with optimum dental health service.

What type of information we have

We currently collect and process the following information:

Personal identifiers, contacts and characteristics for example:

  • the patient’s name, current and previous addresses, bank account/credit card details, telephone number/email address and other means of personal identification such as physical description, gender, date of birth
  • information that the individual is or has been a patient of the practice or attended, cancelled or failed to attend an appointment on a certain day.
  • information concerning the patient’s physical, mental or oral health or condition.
  • information about the treatment that is planned, is being or has been provided.
  • information about family members and personal circumstances supplied by the patient to others.
  • the amount that was paid for treatment, the amount owing or the fact that the patient is a debtor to the practice.

Any other data that is required for the provision of dental services to you, e.g. Facial, Oral photography and digital scanning of the teeth oral tissues, face and radiography.

We may process more sensitive special category data including ethnicity, race, religion, or sexual orientation so that we can meet our obligations under the Equality Act 2010, or for example to modify treatment to suit your religion and to meet HSC obligations.

We never pass your personal details to a third party unless we have a contract for them to process data on our behalf and we will keep all data confidential. If we are required to refer a patient to another practitioner or to secondary care e.g. Hospital, we will gain the individuals permission before the referral is sent and personal data shared.

How we get the information and why we have it

Most of the personal information we process is provided to us directly by you for one of the following reasons:

To provide a personalised and safe environment for the provision of dental services. Such as:

  • Answering phone calls, emails.
  • Organising the diaries and booking appointments for examinations or treatment.
  • To communicate with you as and when required including appointment reminders, treatment plans, estimates, consents and other communications about your treatment or the practice.
  • To communicate with your next of kin in an emergency
  • If a parent or carer, to communicate with you about the person you parent or care for.
  • To maintain your contemporaneous clinical records.
  • To provide you with bespoke dental treatment, prevention, and oral health advice.
  • To carry our financial transactions with you, or debt recovery.
  • To refer you to other dentists or doctors and health professionals as required for your ongoing health care.
  • To obtain criminal record disclosures for team members.
  • To continually improve the care and service you receive from us.

We also receive personal information indirectly, from the following sources in the following scenarios: Website forms, Online patient portal.

Under the Data Protection (Jersey) Law 2018, the lawful bases we rely on for processing this information are:

  • Your consent. You are able to remove your consent at any time. You can do this by contacting: reception@broadstreetdental.je or calling us on 01534 866900
  • We have a contractual obligation.
  • We have a legal obligation to maintain accurate records as required by the General dental Council.
  • We have a vital interest to perform our duties
  • We have a legitimate interest of the dental practice activities.

Our Lawful basis for processing special category data:

  • Processing is necessary for the safe functioning of health care services.
  • Processing is necessary for identifying or keeping under review the existence of absence of equality of opportunity or treatment with the view to enabling such equality to be promoted or maintained.
  • To perform our regulatory requirements such as criminal record checks.

What we do with the information we have

We use the information that you have given us in order to:

  • Provide the ability to reserve appointments, and for the provision of safe and personalised dental services.

We may share this information with:

  • Medical and dental organisations such as clinics, referral centers and Hospitals for the ongoing dental services at your request

How we store your information

Your information is securely stored:

  • Onsite on our secure IT systems and in secure Cloud servers from our Practice management system Dentally.

We keep for:

  • 11 years from your last appointment.

We will then dispose your information by:

  • Confidentially destroying any records and data we hold about you

Your data protection rights

Under data protection law, you have rights including:

  • Your right of access – You have the right to ask us for copies of your personal information.
  • Your right to rectification – You have the right to ask us to rectify information you think is
    inaccurate. You also have the right to ask us to complete information you
    think is incomplete.
  • Your right to erasure – You have the right to ask us to erase your personal information in certain circumstances.
  • Your right to restriction of processing – You have the right to ask us to restrict the processing of your information in certain circumstances.
  • Your right to object to processing – You have the right to object to the processing of your personal data in certain circumstances.
  • Your right to data portability – You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
  • You are not required to pay any charge for exercising your rights. If you make a request, we have four weeks to respond to you.
